- Shipzy/Shipzycart: The package transfer service either by road or air mode of transport.
- Delivery: Means sending the shipment to the parties or providing intimation about the arrival of the shipment at the destination.
- Parties: Includes Shipper, Receiver, or their authorized representatives.
- NCV: No Commercial Value as declared by the shipper.
- Freight: Means the basic freight only and shall exclude other components such as HRR, taxes, and other charges.
- Instrument: Includes cheque, demand draft, or pay order.
2. THE DOCKET IS A CONTRACT BETWEEN SHIPZY/SHIPZYCART AND PARTIES
3. DECLARATION
- The shipments entrusted by the Parties to Shipzy/Shipzycart are booked on a “SAID TO CONTAIN BASIS”. Shipzy/Shipzycart has no obligation to open and check the nature of the shipment but reserves the right to inspect a shipment at its sole discretion.
- The docket is issued based on the declaration given by the Parties. Shipzy/Shipzycart is not responsible for incomplete, inaccurate, or wrongful information, and any liability arising from this is the sole responsibility of the Party providing such information.
- The Parties declare that the shipment covered under the docket does not include any contraband, hazardous, inflammable,fragile, or prohibited articles as defined by various statutes and IATA regulations.
- If Shipzy/Shipzycart finds a discrepancy between the declared and actual weight of the shipment, the differential charges will be collected from the Parties.
4. DOCUMENTATION
- Proper and complete documentation by the Parties is required, including accurate details of the shipper and receiver’s name, address, telephone numbers, email IDs, permits, waybills, invoices, STNs (Stock Transfer Notes), etc., as per statutory requirements.
- Shipzy/Shipzycart will not be held responsible or liable for any deficiencies in the documents, and no claims or grievances will be entertained.
- The Parties undertake to compensate Shipzy/Shipzycart if their shipment(s) cause damage to other shipments loaded in the vehicle due to inherent nature and incorrect declaration or if incomplete documentation results in the seizure of shipments by government authorities, leading to losses for Shipzy/Shipzycart.
5. LIABILITIES
- Shipzy/Shipzycart is not liable for compensation for any delay in pickup and delivery under any circumstances.
- The liability of Shipzy/Shipzycart for lost, damaged, or pilfered shipments is limited to a maximum of Rs. 3,000 (Rupees Three Thousand Only) or the cost of reconstruction, whichever is lower. For clarity, the liability of Shipzy/Shipzycart under this docket is limited to INR 3,000.
- Shipzy/Shipzycart is not responsible for any consequential losses, damages, or claims of any nature.
- Shipzy/Shipzycart assumes no responsibility for material that appears intact at the time of delivery. Claims for damage, shortage, breakage, leakage, or pilferage noticed after delivery will not be entertained. However, the Parties may request open delivery if the shipment appears damaged to assess the loss.
- Shipzy/Shipzycart will not entertain any instruments unless specifically instructed by the shipper.
- Shipzy/Shipzycart is not liable for damages to goods due to improper or defective packing or suitcases or bags that are not locked.
- Shipzy/Shipzycart does not accept Fragile, Electronics, Perishable Foods, Original Government Documents & IDs, Liquid Items, Cheque Books & Cash, Precious & Semi-Precious Jewellery, Cigarettes & Alcohol, Stones & Gems, Illegal Items, Magnetised Materials. Any damages or loss arising during transit to these specific items will not be borne by Shipzy/Shipzycart.
6. FREIGHT REFUND
- Refunds of freight may be considered subject to Force Majeure events such as strikes, bandhs, elections, rains, floods, accidents, festivals, natural calamities (including earthquakes, tsunamis, lockdowns, pandemics), and any other events beyond the control of Shipzy/Shipzycart, including routine and sudden inspections by authorities (e.g., GST, Customs, Gold Control, NDPS, Municipal, RTA).
- Cancellation Policy:
- 10% Charges before pickup
- 30% Charges at the time of pickup
- No Cancellation after pickup
7. PAYMENTS
- If the Parties do not take delivery of the shipment for any reason, Shipzy/Shipzycart will bill the Parties for transportation and other charges as per this docket, and the Parties will be liable to pay all dues at the original booking station or any other station.
- If the receiver does not accept the goods, on written consent and advance receipt of payment, the goods will be rebooked from the destination to the original booking station.
8. STATUTORY PAYMENTS
- The Parties are solely responsible for all payments levied by the government or any statutory body, such as GST or other taxes.
- If a shipment is held up by a statutory authority (e.g., GST, Customs), Shipzy/Shipzycart will not be responsible for consequential losses or freight refunds. The Parties agree to compensate Shipzy/Shipzycart for any claims lodged by statutory authorities due to insufficient documents or wrongful declarations by the Parties/Shipper.
9. LIEN
- Shipzy/Shipzycart has the right to a general lien over all shipments of the Parties for any dues payable to Shipzy/Shipzycart.
10. CLAIMS
- No claims will be entertained by Shipzy/Shipzycart for any loss, shortage, damage, non-delivery, breakage, leakage, pilferage, etc., unless a written claim is lodged within 24 hours from the date of delivery with written remarks on the Proof of Delivery (POD).
- The Parties cannot deduct or adjust any claims, including for loss of Input Tax Credit, GST invoice copy, or delivery challan. Shipzy/Shipzycart will provide necessary cooperation to help the shipper recover duplicate copies and settle claims independently.
- Claims for decay or deterioration due to delays in delivery will not be entertained.
11. DEMURRAGE
- If the Party fails to take delivery of the shipment within 72 hours from the date of tendering, demurrage/warehouse charges of 0.1% of the invoice value or Rs. 0.25 per kg per day, or Rs. 125 per day (whichever is higher) will be charged. Rates may be adjusted by Shipzy/Shipzycart from time to time.
12. GST
- GST will be charged on the total amount of freight and other charges as per applicable rules. GST is payable according to the rules enforced by the concerned authority.
13. ARBITRATION
- Disputes between the Parties and Shipzy/Shipzycart during the term or after the termination of this Agreement will be referred to a sole arbitrator appointed mutually from a list provided by Shipzy/Shipzycart. The arbitration will follow the Arbitration & Conciliation Act 1996 and its amendments. The seat/venue of arbitration will be in Bangalore, Karnataka Telangana, and proceedings will be conducted in English. The arbitrator’s award will be final and binding. The cost of arbitration and enforcement will be borne by the customer.
14. ODA ( Out of Delivery Area)
- ODA (Out of Delivery Area) are remote areas where Shipzy/Shipzycart has to arrange special vehicles for delivery. Charges for these services will be additional to the freight charges. Transit time for these locations will be 2-4 days beyond the regular schedule/assured delivery date provided by Shipzy/Shipzycart.
